Guardianship
When a loved one fails to plan for their future financial and emotional needs with documents such as: a durable power of attorney or living will or trust, the option of last resort is Guardianship.
A Guardian is a person who is appointed by the court to act on behalf of someone’s person, property, or both. A Guardian of the person makes decisions regarding their health and well-being (including medical decisions and their least-restrictive living situation). A Guardian of the property makes sure that routine bills and property taxes are paid, investments are properly done, and contracts are executed. In essence, they are in charge of the person’s overall finances. A plenary guardian is in charge of both.
At Apollo Mediation, we will meet with our clients as often as it takes to find an alternative to Guardianship proceedings. Both expensive and litigious, these proceedings must be looked at as the choice of last resort for your loved one.
